Bankruptcy is a legal process through which people who cannot repay debts to creditors may seek relief from some or all of their debts. With a Chapter 7 bankruptcy case, you may be able to have your credit card or other unsecured debt discharged, and you may also be able to keep your home and vehicle. Adversary Proceedings for Violation of the Bankruptcy Automatic Stay.
When you file for bankruptcy, your creditors are supposed to immediately stop their efforts to collect your debts. This is called the “automatic stay”, and it can even be used to stop evictions or foreclosure sales. When a creditor violates (disobeys) the automatic stay, you may be entitled to money damages.
Adversary Proceedings for Violation of Bankruptcy Discharge
After your Chapter 7 bankruptcy has been granted, most or all of your debt has likely been discharged (cancelled.) If a creditor attempts to collect a discharged debt, you may be entitled to money damages.
There are certain rules debt collectors must follow. If debt collectors do illegal things to you, such as:
Contacting you after you told them in writing to stop
Threatening you with arrest or the forced sale of your property
Using abusive or foul language
Calling you or emailing you at night (between 9pm and 8am),
you may be entitled to seek compensation.
There are two types of consumer protection lawsuits. One is under the Federal Debt Collection Practices Act (FDCPA) in federal court, and one is under the Florida Consumer Collection Practices Act (FCCPA) in state court. Sometimes lawsuits can have elements of both state and federal law.

About the attorney:
Benjamin Picariello, Esq., received his undergraduate degree from Penn State University in 2015, receiving a BA in Political Science, with minors in Spanish and international studies. During that time, he also studied Latin American Political History and Thought at the Universidad de Buenos Aires (UBA), in Argentina. Mr. Picariello then attended the Benjamin Cardozo School of Law in New York City, graduating in 2020. After relocating to Florida, Mr. Picariello worked as a prosecutor in Miami-Dade County, where he specialized in misdemeanor cases, such as DUI, shoplifting, and battery. Mr. Picariello then transitioned into insurance law and successfully handled complex trial cases in the County and Circuit Courts of Florida.
Presently, Mr. Picariello devotes himself to helping people “defeat their debts” using the bankruptcy system. He is licensed to practice law in all state, federal, and bankruptcy courts in Florida.
